What are the guidelines to be followed while naming a company?
The following grounds must be checked before you decide a name for your company:
- Identical Name
The company name can’t be identical or similar to an existing one, LLP (limited liability partnership), trademark. Plural versions of words that are joined together with spaces in between them; using different tenses, adding the name of the place and so on is restricted.
- Trademark
You can’t name your company after a registered trademark since it would infringe on that brand’s rights. Our Company Name Search Tool will show you if your choice of name has already been trademarked.
- Constitution
The company’s name should not contain words that suggest a separate type of business or legal person. For example, the terms “co-op,” “trust” and so on can be used in reference to individuals who own shares but these cannot be a part of the company name.
- Patronage
The proposed name should not have any association or connection with patronage of a national hero and the name cannot imply that you are associated with the Indian or Foreign Government.
- Financial Terms
There can be no financial jargon like insurance, bank, stock exchange, venture capital, asset management, mutual fund, etc. without the appropriate regulatory bodies’ permission.
- Government Relevance
The chosen company name should not have words like National, Indian, Union or Hindustan in it unless prior approval from the government is obtained.
